Terms of Service

In plain English

  • The video you shoot is yours. We never receive it and claim no rights to it.
  • Getting permission to film — from parents, your league and the venue — is your job, not ours.
  • The app is provided as is. Keep backups of games that matter.
  • Paid plans don't exist yet. When they do, section 8 is the part that starts applying.
  • Arizona law governs this agreement.

This box is a summary for convenience. The numbered sections below are the actual terms.

The agreement

These Terms of Service (the "Terms") are a legal agreement between you and OpenVIP, Inc. ("DadSportsNetwork", "DSN", "we", "us"), covering your use of the DadSportsNetwork iPad application and this website (together, the "Service").

By downloading, installing or using the app, you agree to these Terms. If you do not agree, do not use the app and delete it from your device.

You must be at least 18 years old, or the age of majority where you live, to accept these Terms. The app is intended for adults — parents, guardians, coaches and team volunteers. If you let a minor operate the app on your behalf, you remain fully responsible for everything done with it.

Our Privacy Policy explains how the app handles information and is part of this agreement.

Your license to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices that you own or control, in accordance with these Terms and the App Store's Usage Rules.

The app is licensed, not sold. We and our licensors keep all rights in the app itself, including its software, name, logo, scoreboard designs, transition graphics and other branding. Nothing in these Terms transfers any of that to you.

You may not:

  • copy, sell, rent, lease, sublicense or otherwise distribute the app;
  • reverse engineer, decompile or disassemble it, except where that restriction is prohibited by law;
  • remove or alter any copyright, trademark or other proprietary notice;
  • use the DadSportsNetwork name, shield or graphics as your own branding, or in a way that suggests we endorse you, your team or your organization;
  • use the app to build a competing product.

Your footage is yours

You own everything you record. Video, audio, replay clips, the games you film — all of it belongs to you or to whoever you have arranged it with. We claim no ownership of it and no license to it.

We are also not in a position to claim anything: your recordings are written to your own device and are never transmitted to us. We cannot see them, copy them, back them up or recover them for you.

If you use the app's live streaming feature when it becomes available, your video goes directly from your device to the destination you choose. Whoever operates that destination — YouTube, for instance — has their own terms about what they may do with what you upload. Read them.

Before you film

The app points a camera at children playing sports. Using it lawfully and appropriately is entirely your responsibility, and by using it you confirm that you will handle the following yourself:

  • Consent. You have permission from the parents or guardians of minors you film, to the extent your league, club or local law requires it.
  • League and venue rules. You have permission from the league, association, school, club, rink, gym or venue, and you comply with their media, filming and broadcasting policies. Many restrict filming; some prohibit it; some hold exclusive broadcast rights to their own events.
  • The law where you are. Rules about recording people — particularly audio recording, and particularly involving minors — vary by state and by country. Complying with them is on you.
  • Publication. If you post, stream or share a recording, you are the publisher of it, and you are responsible for who can see it and for any consequences of that choice.

Never use the app to record in locker rooms, changing areas, bathrooms, or any other place where a person would reasonably expect privacy.

We are not a party to your arrangements with any league, venue or family, and we do not review, approve or monitor what you record.

Acceptable use

You agree not to use the app:

  • to record anyone without the permission you're required to have, or in any place where recording is prohibited;
  • to harass, stalk, intimidate, exploit or endanger anyone, and especially not a child;
  • to create, store or distribute material that is unlawful, that sexualizes a minor, or that infringes someone else's rights;
  • to violate any law, regulation, court order, league rule or venue policy;
  • to infringe copyright, trademark or broadcast rights — including by streaming an event you don't have the rights to broadcast;
  • to interfere with the app's operation, security or licensing, or to access it by any means other than the interface we provide.

If you break these rules, we may terminate your license to use the app. Where the app runs entirely on your device, the practical consequences of misuse are between you, the people you filmed, and the authorities — which is exactly why the obligations above matter.

Logos and artwork you add

The app lets you import team logos, sponsor artwork and custom replay graphics. By adding them, you confirm that you own them or have permission to use them in a recording or broadcast.

Team crests, league marks and sponsor logos are usually somebody's trademarks. Getting clearance to put them on screen is your responsibility. We store nothing you import — it stays on your device — and we don't check it.

The app will change

DadSportsNetwork is under active development. We may add, change, suspend or remove features at any time, and we may stop supporting older versions of iPadOS or older hardware.

Some features are described on this website or in the app as planned, coming or in build. Those are statements of intent, not promises. They may change, be delayed, or never ship, and you should decide whether to use the app based on what it does today.

Subscriptions and purchases

Not yet in effect

The app currently has no paid plans, no subscriptions and no in-app purchases. This section takes effect only if and when we introduce them, and applies only to purchases made after that point.

When paid plans launch, the following will apply:

  • Billing through Apple. Purchases and subscriptions are processed by Apple through your Apple Account. We never see your payment details.
  • Auto-renewal. Subscriptions renew automatically at the price and interval shown at purchase, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
  • Managing and cancelling. Manage or cancel a subscription in Settings → your name → Subscriptions on your device. Deleting the app does not cancel a subscription.
  • Free trials. If a free trial is offered, any unused portion is forfeited when you buy a subscription. Cancel before a trial ends to avoid being charged.
  • Refunds. Purchases are handled by Apple and are subject to Apple's refund policy. We generally cannot issue refunds ourselves. All fees are non-refundable except where required by law or granted by Apple.
  • Price changes. We may change subscription prices. Changes apply to periods beginning after we give notice, and Apple will ask for your consent where required before charging a higher price.
  • What a subscription covers. A paid plan unlocks features in the app. It is not a guarantee that any specific future feature will be built or kept.

We will not begin charging without updating these Terms and our Privacy Policy first.

No warranty

The app is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We specifically do not warrant that:

  • the app will be uninterrupted, error-free, or free of defects;
  • any particular recording will start, continue, complete or save successfully;
  • recordings will be of any particular quality, or free of dropped frames, thermal throttling, storage exhaustion, or interruption by a phone call, notification, low battery or an operating system event;
  • a live stream will connect, hold, or stay online, which depends on network conditions and on services we don't control;
  • data stored on your device will be preserved.

Keep your own backups of games that matter to you. A youth sports game happens once. We have built the app to protect your recording as carefully as we know how, but no software can promise a file, and a single copy on a single iPad is not a backup.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

Limitation of liability

To the fullest extent permitted by law, DadSportsNetwork and its owners, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or recordings, arising out of or relating to your use of or inability to use the app — including a game that failed to record, a file that was lost or corrupted, or a stream that dropped — whether based in contract, tort, negligence, strict liability or any other theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the app will not exceed the greater of (a) the total amount you paid us for the app in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US$50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence, where such limitation is prohibited by law.

Indemnification

You agree to indemnify, defend and hold harmless DadSportsNetwork and its owners, officers, employees and contractors from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of or related to:

  • what you record, publish or stream, and the circumstances in which you recorded it;
  • your failure to obtain any required consent or permission;
  • logos, artwork or other material you import into the app;
  • your violation of these Terms or of any law or third-party right.

Ending this agreement

You may end this agreement at any time by deleting the app from your devices. We may suspend or terminate your license if you materially breach these Terms.

Sections that by their nature should survive — ownership, warranty disclaimers, limitation of liability, indemnification, governing law and this sentence — survive termination.

Apple App Store terms

Because the app is distributed through Apple's App Store, the following apply and, where they conflict with the rest of these Terms, control:

  • These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content.
  • Your license to use the app is limited to a non-transferable license to use it on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
  • We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
  • If a third party claims the app infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  • You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

Governing law and disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules, and by applicable United States federal law.

You and we agree that any dispute arising out of or relating to these Terms or the app will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts. If you are a consumer in a jurisdiction whose laws give you the right to bring proceedings elsewhere, this section does not take that right away.

Talk to us first. Before filing anything, please email us at the address below and give us 30 days to sort it out. Most problems are a conversation, not a lawsuit.

General

  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the app, and replace any earlier understanding.
  • Severability. If a provision is found unenforceable, the rest stays in force and the unenforceable part is limited to the minimum extent necessary.
  • No waiver. If we don't enforce a provision, that isn't a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
  • Changes to these Terms. We may update these Terms. The "last updated" date at the top and bottom will change, and continuing to use the app after an update means you accept it. If you don't accept a change, delete the app.
  • Force majeure. We are not liable for failures caused by events beyond our reasonable control.
